CapitaLand’s Plant Rewards Campaign Terms and Conditions

  1. Organiser & Eligibility
    1. Plant Rewards Campaign (“the Campaign”) is organised by CapitaLand Retail Malaysia Sdn Bhd (“the Organiser”).
    2. The Campaign is open to all individuals residing in Malaysia above the age of 16, both CapitaStar and non-CapitaStar members, except for those stipulated in paragraph 1.3 below (“Participant”).
    3. The representatives, employees, servants and/or agents of advertising and/or promotion service providers of the Organiser (including its affiliates and/or related companies), and their immediate family members (children, parents, brothers and sisters, including spouses) shall not be eligible to participate in the Campaign:
  2. Duration
    1. The Campaign starts from 18 November 2021 at 12.00 a.m and closes on 15 February 2022 at 11.59 p.m (“Campaign Period”).
    2. The Organiser may at its sole and absolute discretion amend the Campaign Period at any time without prior notice to any party whatsoever. Unless otherwise varied to the contrary by the Organiser, any participation in the Campaign shall be governed by the Terms and Conditions set out herein which shall remain in full force and effect at all times. Entries received outside the Campaign Period shall automatically be disqualified.
  3. How to Register?
    1. Step 1: Participants can access the Plant Rewards platform through social media advertisements, referral link or by scanning QR code in the mall(s). Alternatively, you may access to your Plant Rewards at  plantrewards.capitastar.com.my  with mobile devices.
    2. Step 2: Fill in your name, mobile number and email address and submit.
    3. Step 3: You will receive an OTP SMS to verify your mobile phone number.
    4. Step 4: Enter the OTP on the registration page or click on the link in the same SMS to verify your mobile phone number.
    5. Step 5: Once your mobile number has been verified, you can start your Plant Reward journey by claiming the free seed. Your CapitaStar membership ID will be retrieved if you are already an existing member.
  4. How does the Plant Rewards work?
    1. The Plant Rewards is an Augmented Reality (“AR”) game that allows the Participant to claim Free Seeds, collect Game Tokens & Nutrient Points to grow plant according to the game mechanics and be rewarded when the plants are grown successfully. Participants may also redeem other rewards using Game Tokens. 
    2. Participant need to complete nine (9) levels in order to grow one (1) plant successfully:
      1. Level 1 – 9 : Collect a minimum of eight (8) points for each Nutrient (Water, Sun and Fertilizer) daily to progress each level; and 
      2. Level 10 : Complete one (1) CapitaStar Mission by uploading receipt(s) amounting to a daily minimum spend of RM100 via CapitaStar App during the campaign period. The Management reserves the absolute right to revoke the plant(s) in the event the Management is alerted of any suspicious activities in completing Plant Rewards. Suspicious activities may include but shall not be limited to invalid/fraudulent receipts used or in cases where no receipts have been uploaded via CapitaStar App. 
    3. Participants need to repeat steps above to grow second, third or subsequent plants. Participants can only grow one plant at a time. 
    4. Participant may collect Game Tokens (the primary currency for Plant Rewards campaign) through AR Game, daily check-ins, successful referrals, or other games/challenges prescribed to speed up the plant growing process or win additional rewards.
  5. How to win the rewards?
    1. Participants will be rewarded with RM5 STARVoucher for every full-grown plant, subject to a maximum of 10 plants per Participant during the Campaign Period. Participants may use the Game Token(s) to redeem other rewards such as parking rebates, STARVouchers and any other rewards on the rewards page. (collectively, “Rewards”).
    2. Participants must be a CapitaStar member to receive and utilize the Rewards related to CapitaStar. The Rewards will be credited in the form of edeal directly into their CapitaStar app.
    3. All Rewards are given on an “As is” basis and are non-exchangeable, non-transferable or non-redeemable for cash, credit, other items or voucher, in part or in full. The Organiser makes no warranties or representations whatsoever with respect to the Rewards and shall not be responsible nor liable for any problems and/or damage there to or arising there from.
    4. Each Participant is entitled to a maximum of 5 redemptions for each Reward.
    5. The Organiser reserves the right at its absolute discretion to substitute any of the Rewards with alternative rewards of similar value, at any time without prior notice.
    6. Completed entries must be received by the Organiser latest by 15 February 2022, 11:59pm. Entries received after the stipulated time will be disqualified and ineligible for consideration for the Rewards,
    7. The Participant is responsible for any and all taxes payable as a result of Rewards being awarded or received (if applicable).
    8. In the event that the Participant chooses not to accept the Rewards, the Reward shall be forfeited and the Rewards will be dealt with according to the absolute discretion of the Organiser.
    9. All Rewards are accepted entirely at the risk of the Participant and are awarded by the Organiser and/or sponsors without any warranty of any kind express or implied. The Participant shall execute a deed of release and indemnity in a form prescribed by the Organiser, if so required, in order to receive the Rewards.
    10. The Organiser reserves the absolute right to disqualify any individual that it determines to be tampering with the entry process or the operation of the Campaign or to be acting in breach or potential breach of the Campaign’s Terms and Conditions.
    11. The Organiser’s decision on selection of winners is final, conclusive and binding. No correspondence or dispute will be entertained.
  6. Retain original SMS and E-mail for verification purposes.
    1. The Organiser, its related and associated companies, and its agencies and companies associated with the Campaign disclaim any and all liability arising from the Campaign and will not be responsible or held liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) resulting from any Participant’s participation in the Campaign, redemption and/or usage of the prize(s), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
    2. By participating in the Campaign, all Participants agree to defend, indemnify and hold the Organiser harmless from and against any suits, claims, losses, damages and expenses, including reasonable legal fees that may be arise from or in connection with the Campaign.
  7. Right of Organiser
    1. All entries will be the property of the Organiser and the Participants will not claim, use, or exploit the entries for any purpose by any means at any time. By entering the Campaign, each Participant agrees that the Organiser reserves the right to publish, use the names and/or photographs of the Participants and/or winners as material for advertising and/or publicity purposes without payment or prior notice, and further agree that by entering the Campaign, the Participants and /or the winners waive all rights associated with the image they have submitted for the campaign. Participants shall not be entitled to claim ownership or other forms of compensation on the materials.
    2. By entering the Campaign, each Participant is deemed to have read, understood all the Terms and Conditions of the Campaign and they are fully and unconditionally agreed to be bound by it (as varied or changed). The Organiser reserves the right to amend these Terms and Conditions where necessary for legal, technical or commercial reasons and any such amendments shall be effective on the posting of the Campaign website. Please check these terms and conditions regularly to see if there have been any changes.
    3. The Organiser reserves the right to modify, suspend or cancel the Campaign at any time without prior notice in the event that it becomes incapable of running as planned, technically interfered or corrupted, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Organiser, despite the best efforts of the Organiser.
    4. Any terms and conditions applicable to the Campaign which is illegal, prohibited or unenforceable under any law or regulation shall be ineffective to the extent of such illegality, voidness, prohibition or unenforceability without invalidating the remaining provisions.
    5. These Terms and Conditions are governed by and construed under the laws of Malaysia.
  8. Personal Data
    1. By entering this campaign, the Participant hereby agree that the Organiser, its related and associated companies, and its agencies and companies associated with the Campaign may collect, obtain, store and process Participant’s personal data that has been provided for the purpose of receiving updates, news, promotional and marketing mails or materials from the Organiser.
    2. Examples of Participant’s Personal Data which may be collected, used, disclosed and/or processed
      for the Campaign include the following:
      1. Participant’s name, a valid mobile number, images of receipts and any other information relating to Participant which have been provided consent to the Organiser through forms or in other forms of interactions between the two parties;
      2. information pertaining your usage and interaction with the products and services under the Campaign and/or the Campaign’s Website including traffic to and from Campaign Website ; and/or
      3. photographs or audio-video or other recordings that has been taken in connection with the Campaign.
    3. In particular but without limiting the content of Clause 8.1, the Organiser would have the consent of Participant in relationship with the Campaign to collect, use, disclose and/or process Participant personal data for the following purposes strictly in relation to the purposes of the Campaign:
      1. responding to Participant’s queries, requests and/or feedbacks ;
      2. sending Participant’s notifications as well as marketing and promotional messages under and in relation to the Campaign (including SMS and e-mail) such as information, updates and/or advertisements and/or other communications in connection with the process of the Campaign ;
      3. carrying out profiling and statistical analysis to improve the Campaign ; and
      4. compliance with any applicable rules, laws and regulations, codes of practice or guidelines or to assist in law enforcement and investigations by relevant authorities.
    4. In addition to clause 8.1 and 8.2, Participant(s) hereby agree to provide consent for the collection, use, disclosure and/or processing of personal by the Organiser and its marketing partners and/or authorized service providers for the following purposes:
      1. communicating and providing services including offers, advertisements, promotions or activities conducted at any of the Organiser’s property in relation with the Campaign.
      2. matching Participant’s personal data with other data collected for other purposes and other sources in connection with the provision of the Campaign whether by the Organiser or third parties that are in direct relation with the Organiser.
      3. administering and conducting the Campaign on behalf of the Organiser including announcing the
        results of the Campaign, identifying and contacting winners and publicising and conducting marketing related to the Campaign.
      4. sending you details of the Campaign and Rewards
      5. conducting consumer and market related research, understanding and determining customer preferences and demographics for the Organiser to review, develop and/or improved products, services and marketing communication activities.
      6. informing the Participant via email, SMS and other means of communication about or in relation to the Campaign.
    5. Participant(s) hereby agree that the consent granted herein do not supersede or replace any other consents that have been previously granted to the Organiser in respect of Personal Data for the collection, usage, disclosure and/or processing.

  9. Anti-Corruption
    1. The Participant acknowledges that the group of which the Organiser forms part is committed to conducting its business in an ethical manner and expects all its employees and parties with which it has a contractual relationship to conduct themselves with high ethical standards and to comply with applicable laws for the suppression of corrupt practices (“Anti-Corruption Laws”).
    2. The Participant, represents and warrants that, to the best of its knowledge, neither it nor any person who (by reference to all relevant circumstances) performs services or acts for or on behalf the Participant in any capacity (including, without limitation, employees, agents, related corporations, and subcontractors) (“Representatives”) has contravened, or procured or encouraged third parties (including, for the avoidance of doubt, the employees or any person acting on the Organiser’s behalf) to contravene any Anti-Corruption Laws in connection with the Agreement.
    3. The Participant shall immediately notify the Organiser if, any person employed by the Organiser or acting on the Organiser’s behalf or any of the Participant’s Representatives, has contravened or attempted to contravene any Anti-Corruption Laws in connection with the Campaign, and shall take adequate steps to protect the interests of both Parties. All notices to the Organiser in this regard should be sent to the Head of Group Internal Audit of CapitaLand Limited at the following email address   Whistleblowing.ACChair@capitaland.com.
    4. The Organiser shall be entitled to terminate this Campaign forthwith if the Participant or any of its Representatives has contravened or attempted to contravene any Anti-Corruption Laws, whether in connection with the Campaign or otherwise. Such termination shall be without prejudice to the Organiser’s other rights and remedies whether under the Campaign or otherwise.
